(a) Declaring a Seat Vacant. The Council shall declare a Council seat vacant when a seat is forfeited, or when a Council member resigns or is removed, recalled, fails to qualify as a tribal member, commits a felony while in office, or is physically or mentally unable to perform the duties of a Council member as determined by an affirmative vote of at least four Tribal Council members.

(b) Filling Vacancy by Appointment. The Tribal Council may appoint a person to fill a vacancy on the Tribal Council until the next Tribal Council election, by a majority vote of remaining Council members. A person so appointed shall only serve until the next Tribal Council election at which time a qualified person shall be elected to carry out the remaining portion of the term.
