The Court of Appeals shall decide all cases by majority vote. The decision shall be based on the briefs or statements of the parties, the record of the trial court, and oral argument, if any. The Court of Appeals shall issue a written decision and all judgments on appeal shall be final. The decision of the Court of Appeals shall affirm, reverse, modify, or amend the decision of the Tribal Court. It may order that the case be remanded for further proceedings in the Tribal Court or for retrial in accordance with directions from the Court of Appeals. [2008 Code § 2.4.17; Res. 1999-17]
