(a) Grounds for appeal are limited to cases:

(1) Of error of law at trial.

(2) Of a verdict contrary to the law or evidence; but in no event may the Tribal Government of St. Paul Island appeal from a jury verdict of not guilty in a criminal case.

(3) Of perjury of a witness.

(4) Where substantial justice has not been done.

(5) Of a denial of a new trial under ATC 2.10.50, 2.10.60 or 2.10.70.

(6) Of a denial of a stay of enforcement of the Tribal Court judgment pending appeal.

(b) Remand for New Trial.

(1) Under no circumstances shall the Court of Appeals conduct de novo reviews.

(2) If, in the opinion of the Presiding Judge, the Tribal Court record is inadequate, the Court of Appeals shall remand the case to the Tribal Court for a new trial or for further proceedings in accordance with the directions of the Court of Appeals. [2008 Code § 2.4.3; Res. 1999-17]
