(a) Except as limited by this title, the judgment of the Tribal Court shall be enforced pending an appeal; provided, that a stay of enforcement shall be granted by the Tribal Court if enforcement of the Tribal Court’s judgment will result in manifest injustice.

(b) In a civil case, the Tribal Court shall require the appellant to post a bond sufficient to guarantee performance of the Tribal Court judgment if the judgment is affirmed on appeal, and may require an additional bond to guarantee payment of such costs or interests as the Court of Appeals might award.

(c) In a criminal case, the Tribal Court may require the appellant to post a bond sufficient to guarantee performance of the Tribal Court judgment if the judgment is affirmed on appeal, and may require an additional bond to guarantee payment of such costs or interests as the Court of Appeals might award.

(d) Upon proper filing of the petition, bonds for indigent appellants in criminal cases shall be waived.

(e) In criminal cases, respondents shall be released on personal recognizance or admitted to bail in accordance with this code. [2008 Code § 2.4.6; Res. 1999-17]
