(a) There may be more than one participant in any one session of An’gim Tunuu.

(b) Any person who is named as a respondent in a matter before the Tribal Court may be a participant in An’gim Tunuu and may consent to participation for the determination of penalties as an alternative to appearing in a trial on the matter. Participation in An’gim Tunuu may be considered a mitigating factor by the Tribal Court when issuing a final order on a respondent’s penalties. Consent to participation in An’gim Tunuu waives a respondent’s rights to dispute the facts and allegations made by the petitioner.

(c) Any person with a dispute may request participation in An’gim Tunuu as an alternative to filing the matter in Tribal Court. All parties to the dispute must consent to participation in An’gim Tunuu and to have the matter resolved through An’gim Tunuu and not by a Judge of the Tribal Court. Participation by the requesting parties in An’gim Tunuu is voluntary; however, compliance by the parties with the decisions rendered from An’gim Tunuu is mandatory. Failure of the parties to comply with any decision issued by An’gim Tunuu will be processed in the same manner as failure to obey a Tribal Court order, in accordance with the code.

(d) Any person who is receiving services or assistance from any Tribal Government department may be referred by the department to An’gim Tunuu as a participant requiring dispute resolution or restoration. The referral shall be filed with the Tribal Court for approval by a Tribal Court Judge. Continued services from the Tribal Government department, or any other Tribal Government department, may be contingent upon the person participating in An’gim Tunuu in accordance with the referral.

(e) Participants who are not tribal members of the Aleut Community of St. Paul Island must consent, in writing, to the jurisdiction of both An’gim Tunuu and the Tribal Court. [Res. 2012-25; 2008 Code § 2.7.5]
