(a) A Notice of Civil Infraction represents a determination that a civil infraction has been committed. The determination is final unless contested as provided in this chapter.

(b) The form for the Notice of Civil Infraction shall include the following:

(1) Name and address of the alleged offender;

(2) Tribal identification number, if any;

(3) Location, time, and date of offense;

(4) Description of offense;

(5) Citation to tribal ordinance provision or unwritten tribal law;

(6) Scheduled date and time for Tribal Court appearance;

(7) Penalty for nonappearance;

(8) Amount of no-contest monetary penalty;

(9) Identification of issuing officer;

(10) Time and date of issuance;

(11) A statement that the notice and the determination of civil infraction is final unless contested as provided in this chapter;

(12) A statement of the civil penalty established for the civil infraction;

(13) A statement of the options provided in this chapter for responding to the notice and the procedures necessary to exercise these options;

(14) A statement that the person must respond to the notice before the scheduled date and time of the Tribal Court appearance;

(15) A statement, which the person shall sign, that the person promises to respond to the Notice of Civil Infraction in one of the ways provided in this chapter. [Res. 2012-27; 2008 Code § 3.2.6]
