“Child” means a person under the age of eighteen (18) years old, or a person aged eighteen (18) years or older whom the Tribal Court has found to be a “child” for purposes of this chapter.

“Child protection worker” means a person designated by Children Services to investigate allegations that a child is in need of protection, and who is authorized to take temporary custody when necessary and to provide services to the child and the child’s family.

“Children Services” means the Aleut Community of St. Paul Island Children Services Unit within the Personal and Family Services division of the Department of Health and Human Services, or the equivalent division or department.

“Court” or “Tribal Court” means the St. Paul Island Tribal Court.

“Custodian” means a person who has legal or physical custody of a minor under tribal law or custom or under state law and who is providing food, shelter, and supervision to the minor.

“Guardian” means a person other than the minor’s parent who is, by law, responsible for that minor.

“Indian” means a person who is:

(1) A member of or eligible for membership in a federally recognized Indian tribe;

(2) A descendent of an enrolled member of the Aleut Community of St. Paul Island; or

(3) Is otherwise considered a member of the Aleut Community of St. Paul Island.

“Indian child” means a child who is:

(1) A member of or eligible for membership in a federally recognized Indian tribe;

(2) A descendent of an enrolled member of the Aleut Community of St. Paul Island; or

(3) Is otherwise considered a member of the Aleut Community of St. Paul Island.

“Member” means a person enrolled or eligible for enrollment in the Aleut Community of St. Paul Island under ATC Title 1.

“Parent” means the natural or adoptive parent of a child, but does not include a person whose parental rights have been terminated.

“Party” or “parties” mean any person who has a legal interest in a Tribal Court matter, including the Aleut Community of St. Paul Island, a child, a child’s parent(s), guardian(s), or custodian(s), or any other family member of the child permitted by the Tribal Court to participate as a party to the matter.

“Sexual abuse” means any unwanted, improper, or harmful sexual activity imposed upon an individual by another, and includes, but is not limited to: sexual touching of any part of the body, clothed or unclothed; encouraging a child to engage in sexual activity; intentionally engaging in sexual activity in front of a child; showing a child pornography or using a child to create pornography; or any other act deemed sexual and improper or harmful by Children Services or the Tribal Court.

“Tribe” means the Aleut Community of St. Paul Island. [Res. 2012-56; 2008 Code § 6.2.3]
