(a) Upon filing of the petition, Children Services, or other qualified person appointed by the Court, shall prepare a pretermination report that provides the Court with findings and recommendations on termination of parental rights. In preparing the report, the person shall consult with the child’s parent(s), guardian(s), or custodian(s), and all social services, health, and education personnel who have had prior professional contacts with the child and the child’s parent(s), guardian(s), or custodian(s), to determine whether termination of parental rights would be in the best interest of the child. The report may contain reference and review of any previous court record in any jurisdiction for the child or the child’s parent(s), guardian(s), or custodian(s).

(b) The report shall be presented to the Tribal Court at least fifteen (15) working days prior to the termination hearing. [Res. 2012-57; 2008 Code § 6.3.3(1)]
