The following terms are defined for the purpose of this chapter:

“Comanagement Agreement” refers to the agreement between the Aleut Community of St. Paul Island and the National Marine Fisheries Service that covers the northern fur seal and Steller sea lion.

“Ecosystem Conservation Office” means the Tribal Council approved department of the Tribal Government that has designated authority to manage environmental and resource issues for the Tribe.

“Harvest” means the organized hunting of fur seal as allowed by this chapter and 50 CFR Ch. II Section 216 Subpart F.

“Harvest Management Plan” refers to the current Northern Fur Seal Subsistence Harvest Management Plan, St. Paul Island, Alaska, that has been approved by the St. Paul Tribal Council.

“Hunt” and its derivatives, “hunting,” “hunted,” etc., means any effort or attempt to kill, injure, or capture a fur seal.

“Non-tribal member” means any person who is not enrolled in the Aleut Community of St. Paul Island as defined by Article II of the Constitution and Bylaws of the Aleut Community of St. Paul Island and Chapter 1.45 ATC.

“Northern fur seal” means laaqudaax in Unangam tunuu (Aleut language) or the species Callorhinus ursinus (hereinafter referred to as fur seal).

“Ordinance” means a tribal law intended to establish written procedures and guidance for the St. Paul Island Tribal Government, its members regardless of where they reside, and for those persons and entities that enter into consensual relations with the Tribe or its members, or affect the health, safety, welfare, or economic or political integrity of the Tribe or its members.

“Traditional harvest ethics” means the long-standing unwritten harvest practices and knowledge held by the Tribe as determined by Elders of the Tribe.

“Tribal Council” means the governing Council of the Aleut Community of St. Paul Island as defined by Article III of the Constitution and Bylaws of the Aleut Community of St. Paul Island and Chapter 1.25 ATC.

“Tribal Court” means the St. Paul Island Tribal Court or the organized judicial body or court for the Tribe as defined by ATC Title 2.

“Tribal Enforcement Officer” means the designated persons sworn in by a Tribal Court Judge that have the authority to enforce the laws, regulations, and ordinances of the Tribe.

“Tribal Government” means the Tribal Government of St. Paul Island, which is the government service arm of the governing body.

“Tribal member” means a person enrolled in the Aleut Community of St. Paul Island as defined by Article II of the Constitution and Bylaws of the Aleut Community of St. Paul Island and Chapter 1.45 ATC.

“Tribe” means the Aleut Community of St. Paul Island as defined by ATC Title 1 and ATC 1.05.30.

“Unaa}in” or “Unaa}im” means those across the sea or the people of the Pribilof Islands.

“Waste” and “wasteful manner” mean the harvest of a fur seal which is likely to result in the killing of a fur seal beyond those needed for subsistence, subsistence uses, or for the making of authentic Unaa}im articles of handicrafts and clothing, or which results in the waste of a substantial portion of the animal. The harvest of a fur seal merely for parts (i.e., flippers, internal organs, or the fur) will be considered waste. A “butterfly cut” is not considered waste. [Res. 2009-39; 2008 Code § 7.2.3]
