(a) If the OJA Director denies a corporation’s application for reinstatement following administrative dissolution, the OJA Director shall serve the corporation with a record that explains the reason or reasons for denial.

(b) The corporation may appeal the denial of reinstatement to the Tribal Court within thirty (30) days after service of the notice of denial is perfected. The corporation appeals by petitioning the Tribal Court to set aside the dissolution and attaching to the petition copies of the OJA Director’s certificate of dissolution, the corporation’s application for reinstatement, and the OJA Director’s notice of denial.

(c) The Tribal Court may summarily order the OJA Director to reinstate the dissolved corporation or may take other action the Court considers appropriate.

(d) The Tribal Court’s final decision may be appealed as in other civil proceedings. [Res. 2011-32; 2008 Code § 9.3.5.7]
