(a) For the purpose of this section, “all-terrain vehicle” or “ATV” means any recreational vehicle, such as a three-wheeler, four-wheeler, six-wheeler, motorcycle, mini-bike, snow machine or side-by-side, that is capable of traveling on trails or on any one of the following or a combination thereof: beach, land, water, snow, ice, marsh, swampland, and natural terrain.

(b) All minors in operation of an ATV must wear a DOT-compliant helmet with the chinstrap fastened.

(c) All minors under sixteen (16) years of age in operation of an ATV must be in direct supervision of or accompanied by adult.

(d) Neither a parent or guardian of a minor under sixteen (16) years of age, nor an adult who is authorized by the parent or guardian to supervise that minor, shall grant permission to, or knowingly allow, that minor to operate an ATV in a manner that violates this section.

(e) Minors in operation of an ATV must not operate the ATV in any manner intended or reasonably to be expected to harass, drive or pursue any wildlife.

(f) Minors in operation of an ATV must not operate the ATV in a careless or negligent manner or in a manner so as to endanger a person or property.

(g) Minors in operation of an ATV must not operate the ATV within a cemetery, historical cultural site, subsistence berry patch, or other important subsistence area.

(h) Minors in operation of an ATV shall operate the ATV on roads, designated sand dunes and beaches, and well-established trails only; ATVs shall not be ridden on the tundra.

(i) No minor shall operate an ATV while under the influence of alcohol or drugs or intoxicants.

(j) No minor in operation of an ATV may carry a passenger. [Res. 2012-43; 2008 Code § 4.3.8]
