(a) Recounts. Any tribal member may ask for a recount of ballots cast in tribal elections; provided, that the outcome is within five votes. The request must be made within three days after a special election at the annual meeting for an election of Tribal Council members. Recounts shall be done in front of the tribal member requesting the recount, and all three Election Judges shall be present. Recounts for special elections shall only be done during convenient hours for the Judges to meet.

(b) Challenging Election Results. Tribal members may challenge election results if the terms of the Aleut Community of St. Paul Island Constitution or the St. Paul Island Tribal Election Code have allegedly been violated. Such challenge may be done through a petition and election process. A petition must be circulated and signed by at least fifty-one percent (51%) of the qualified tribal voters residing in St. Paul. The petition shall state the alleged violation of the St. Paul Constitution or Code. Such petition shall be submitted to the Council within seven days after the election, or the challenge may not be brought. Once presented to the Council, the Council shall hold a new election following the procedures outlined in the procedures for special elections. If the Council fails to hold such an election within thirty (30) days after receiving the petition, the tribal membership may meet to conduct a new election. At such a meeting, at least thirty percent (30%) of the qualified tribal voters residing in St. Paul shall be present. [Certificate of Adoption passed April 22nd, 2008; 2008 Code § 1.7.8]
