(a) All records created or obtained under this title shall be confidential and not open to inspection, except by the juvenile, the juvenile’s attorney or advocate, the juvenile’s parent(s), guardian(s), or legal custodian(s), Tribal Court personnel, Tribal Enforcement personnel, the Tribe’s Presenting Officer, relevant personnel of the Tribe’s Department of Health and Human Services, and any other person who is allowed access to records either by consent or by order of the Court based on a legitimate interest in the particular case or matter.

(b) Upon agreement to maintain the confidentiality of the records, juvenile records may be provided to:

(1) A treatment provider providing treatment to the juvenile;

(2) Law enforcement agencies in other jurisdictions that have a legitimate law enforcement interest in the juvenile;

(3) Juvenile justice agencies in other jurisdictions that are providing services to the juvenile; or

(4) Organizations seeking to provide services for a juvenile in their care. [Res. 2012-41; 2008 Code § 4.1.5]
